Article 1 – Acceptance of the terms and conditions of sale
These general conditions of sale govern the contractual relationship between SARL SERIE NOIRE and client, which both parties shall fully accept. These terms and conditions shall prevail over all other conditions contained in any other document.
Purchases made on the site www.serie-noire.fr shall indicate full acceptance of these terms. The company reserves the right to amend these at any time without notice. The buyer acknowledges having read the general terms and conditions and fully accepting these before making any purchase on www.serie-noire.fr.  The buyer should have full legal capacity or hold legal authorization to place an order on our website. The buyer undertakes to make payment for purchases using a bank account which contains sufficient funds.

The buyer undertakes to make payment for purchases using a bank account which contains sufficient funds.

Article 2 -- Features and Availability

Every product offered on this site is featured and detailed on a sheet, complete with photo(s).

We strive to provide images of the product which are as accurate as possible. However, in some instances, we cannot ensure perfect similarity with the merchandise delivered. Some colors may be dissimilar as a result of studio lighting, the quality of the display settings, color registration and / or light quality.

The merchandise sold on the site www.serie-noire.fr is available in our store and shipped from our checkout. Products that may be unavailable are specified as such, and cannot be part of a transaction.

Despite the care and attention of our staff, some items may be unavailable when they are listed as available, and in the event of an order having been already submitted, www.serie-noire.fr shall:

  • Notify the buyer by email of the cancellation of unavailable items.
  • Cancel the bank transaction.

Article 3 – Price

Product prices on www.serie-noire.fr are expressed in euros, all taxes included, excluding shipping (free shipping in France and Europe with Colissimo). The current rate of VAT is 19.6%. Any changes in the statutory rate will be reflected in product prices. When ordering, the full price of the products is subject to VAT. Prices shown are subject to change by www.serie-noire.fr at any time without notice. The price in euros at confirmation of the order shall be the final invoiced price. Any difference in price on the same product charged during another occasion of sale is not refundable.  Shipping charges are added to the total order and may vary according to weight and shipping address of ordered items.

Article 4 – Order Confirmation

To order on www.serienoire.fr, the buyer should:

  • create an account, under “Login” or “My Account → Register”
  • choose a  confidential password, which should be retained for future visits.The username (which can be a pseudonym) and password will protect buyers' identity and the confidentiality of their personal information.
  • this process should take only a few minutes. During this time, the complete shipping address can be provided, for the receipt of a confirmation and an account summary. The account can be created prior to the order.  

The customer's access on the site is limited to:

  • the selection of one or more articles on the site.
  • the placing of items into a virtual shopping cart. The contents of the cart can be stored, viewed and changed at any time during the customer's visit. Sizes and quantities can also be amended.

After the addition of each article to the shopping cart, the customer can:

  • continue shopping
  • save the selection if not placing an order immediately
  • delete individual items or delete the entire selection
  • complete the selections by clicking on “Order”

 

The sale is completed after the final confirmation on the payment screen. The customer is now a buyer. However, www.serienoire.fr reserves the right to cancel an order if there is found to be any  legal action related to any previous order. Additionally, www.serienoire.fr reserves the right to delay  or suspend the delivery of any new orders in the case of late payment on a previous transaction.

To conclude the sale, a confirmation email listing the purchased items will be sent within a few minutes to the email address provided during ordering. If no email is received, please inform customer services at contact@serienoire.fr. 

All transactions are stored online in order to provide a record of the order and to serve as proof (of date, subject, and contents) of a contractual relationship between the parties involved.

However, the buyer should take the necessary steps to safeguard the details of their transaction with www.serie-noire.fr, especially in any case of data loss by the company. (for example, in the case of a force majeure).

An invoice, including VAT (if applicable) will be emailed to the buyer and will also be enclosed in the delivery package. 

The information provided by the buyer during ordering should contain no errors or omissions, in particular the delivery address and contact telephone number (to be used by the delivery services, if required). The seller assumes no responsibility for any failure of delivery of the ordered items due to any errors in information provided by the buyer.

 

Article 5 – Accepted Payment Methods

All payments shall be made in euros (€). Bank credit cards are accepted. CIC BANQUES provides a secure mode of payment for all bank credit card transactions. During  payment for your purchases on www.serie-noire.fr, you will be directed to the secure server at CIC BANQUES, which guarantees the complete protection of your bank information, which is securely encrypted and cannot be obtained by any unauthorized parties. Thus www.serie-noire.fr does not at any time have access to your bank information. This information is not stored on our server. Before the validation of any transaction, CIC BANQUES will verify several elements:

  • the validity of the payment method
  • the sufficiency of the cardholder's funds for the purchase 
  • the credit card is genuine

The buyer's order is not valid and does not take effect until CIC BANQUES provides approval. If a payment is declined, the order is automatically cancelled and the buyer shall be notified via email.

Article 6 – Ownership of property

In accordance with law, n°80.335 of 12 May 1980, the merchandise remains the property of  www.serie-noire.fr until receipt of full payment.

 

Article 7 – Delivery

Deliveries are made via post to the address provided by the buyer, (www.serie-noire.fr does not accept any p.o.box and poste restante addresses and shall reserve the right to cancel any orders to such addresses). Only one delivery address can be provided for each order. If merchandise is to be shipped to two separate addresses, the buyer should place two different orders, on which delivery charges to the respective destinations shall be charged. The actual buyer shall be the person named in the invoice.

 

Delivery tracking

Packages on the buyer's account can be tracked on www.coliposte.fr, using the colissimo number provided during the confirmation of shipping.

 

If merchandise cannot be delivered

In the case of force majeure or chance (fire, theft of work equipment, bad weather, stock unavailability from the manufacturer, accidents, internal or external breakdowns, loss of data, strikes by postal, transport, communication and fuel supply services), www.serie-noire.fr shall be discharged from its obligation to deliver the merchandise.

 

Delivery Risks

The buyer shall verify the general condition of the package during its receipt. If possible, this should be done in the presence of the delivery personnel. In the case that the package is found to be damaged or any merchandise found to be missing during transport, the buyer should:

  • record, in writing, any damage or missing items and sign on the delivery note.
  • refuse delivery of the package and note the reasons for refusal, then sign on the delivery note.
  • send a registered letter with the receipt, dated and signed, listing the reasons for refusal of delivery, within four days from the date of delivery, to the delivery service company.
  • forward a copy of the same by email to: contact@serie-noire.fr or mail to: SARL 14 rue Lepelletier BLACK SERIES 59000 LILLE. Please include all order and delivery details.  Claims shall only be considered if the reasons for refusal of delivery are handwritten on the delivery note, and if www.serie-noire.fr was informed in a timely manner.

In other words, no claim of any nature can be entertained if the package has been accepted without any objection and if the seller has not been informed in accordance with the above conditions. A postal enquiry shall be initiated and its conclusion shall decide whether or not any reimbursements are made.

 

Non-receipt of merchandise

You should inform us if your order has not been received within a maximum of 30 days after the date of payment for your order. After this date, no further claims can be made.

 

Mode, time and rates of delivery

Delivery times (in working days) indicated are approximate only and provided by our transporter, La Poste. This means that the buyer cannot demand any cancellation, claim damages or seek compensation of any kind whatsoever. www.serie-noire.fr shall not be held responsible for delays attributable to the carrier for any reason whatsoever. The shipping / transport shall be borne by the buyer and are calculated automatically according to the country of delivery indicated on the order, and the total weight of the package.

 

Package delivered against signature

In the absence of the recipient, the package shall be delivered to another person authorized by the buyer, or a notice for collection shall be deposited in the mailbox. In this case, the buyer shall collect the package from the post office indicated on the notice. After this date, the package shall be returned to the sender. Any requests to re-send the package shall incur additional charges. www.serie-noire.fr cannot provide refunds under any circumstances associated with such non-delivery of merchandise.

Article 8 – Cooling-off period and return of goods

In accordance with articles L121 of the Consumer Code, you have seven days (as indicated by the postmark), from the receipt of the merchandise to change your mind about your order. After this time, no returns shall be accepted and the merchandise is considered accepted by you. If you would like a refund, return the merchandise, at own your expense, by registered post with the delivery receipt to the address below, subject to these conditions:

  • the merchandise must be in its original condition, unworn, altered, soiled or laundered. Trying-on of the merchandise is permitted but it should not be subjected to prolonged or repeated use prior to its return. No refund shall be given on any items which do not meet the above criteria.
  • all accessories including labels and tags shall be intact.
  • merchandise should be in its original packaging (box, tissue paper or wrapping paper)

No requests for refunds made via telephone shall be entertained. No refund of carriage forward or contra-payments shall be accepted. www.serie-noire.fr will reimburse the total amount of the returned articles within 30 days of receipt of your intention to return the merchandise. The buyer shall be responsible for the cost of returning the merchandise. The buyer has the responsibility to retain proof of return of the merchandise. We recommend that you return the merchandise by mail or by registered mail, with return receipt requested, or by any other means that will prove the mailing date. Refunds will be made via bank transfer to your bank account or by cheque in your name. In cases of exchanges for size or color, a new order shall be made.

 

Defective Products

The buyer should check that the merchandise received is according to the order, and inform our customer services immediately of any deviations. If, despite all necessary care taken in the selection of our merchandise, a product is found to be defective,

1- The buyer should inform our customer service as soon as possible after the receipt of the merchandise by email: (contact@serie-noire.fr) or by mail, to SARL SERIE NOIRE, 14 rue Lepelletier 59000 LILLE.

2- Subject to the merits of a request for refund, www.serie-noire.com shall accept the return of the defective merchandise at the buyer's expense.

3- www.serie-noire.fr will refund the value of the defective merchandise (price of the item on the day of purchase) and the buyer's costs of the return of the defective merchandise.

 

Article 9 – The responsibilities of the company

Our online boutique is open for business 24 hours a day, 7 days a week, except in cases of: 

  • force majeure, 
  • problems with the internet network (interrupted connections, server issues, computer viruses) 
  • interruption of electricity supply, loss of data
  • a notice on the welcome page of the site.

 

www.serie-noire.fr shall not be responsible for the contents of any sites that may be accessed via its site. The presence of these links does not mean any endorsement, in part or in full, of these sites. 

 

Article 10 – Guarantee 

In all cases, www.serie-noire.fr cannot be held responsible for the rules or regulations in force in the destination countries. The responsibility of  www.serie-noire.fr is solely limited to the value of the merchandise in question, determined by the date of its sale, and there shall be no recourse against the brand or against the company which produced the merchandise. 

In all cases, the buyer is protected by the guarantee under section 1625 of the Civil Code on returns and on hidden defects.

Article 11 - Legal information

The collection of buyers' information during an online sale is necessary as this information is used for the processing and delivery of orders, the preparation of invoices and of contractual warranties. Any missing information shall result in the invalidity of the order.

According to the law on “Information Technology and Freedoms” the processing of buyers' personal information is subject to the regulations under the Commission Nationale Informatique et Libertés (CNIL). According to Article 34 of the Act of January 6, 1978, the buyer has the right to access, modify, rectify and delete any personal data, which can be exercised via HVS Diffusion.

Additionally,  www.serie-noire.fr undertakes not to divulge, for free or in exchange for information,    customers' information to any third parties.
